THE LEGAL FRAMEWORK FOR QUALITY ASSURANCE IN NIGERIAN HIGHER EDUCATION: AN ANALYSIS OF THE NATIONAL UNIVERSITIES COMMISSION ACT AND ITS IMPLEMENTATION CHALLENGES

Abstract

Quality assurance stands as a cornerstone for building credible higher education systems across the globe. In Nigeria, the National Universities Commission serves as the principal regulatory authority responsible for maintaining academic standards in all universities. This paper examines how effectively the legal provisions within the NUC Act translate into actual quality outcomes on university campuses. The research analyzes statutory instruments, policy documents, and current implementation practices to reveal substantial disconnects between what the law requires and what institutions actually experience. Several major obstacles prevent the NUC from fulfilling its quality mandate effectively. These include chronic underfunding of universities, deteriorating physical infrastructure, severe shortages of qualified academic staff, and weak enforcement of regulatory standards. Universities struggle to meet even minimum academic standards because the resources they receive fall drastically short of what regulations demand. The findings show clearly that strong legal frameworks cannot guarantee educational quality when basic material conditions remain inadequate. This paper recommends that government increase funding for higher education substantially, that the NUC strengthen its monitoring systems, that regulatory agencies improve their coordination, and that universities receive targeted support to build their capacity for sustaining quality improvements. Nigerian higher education will continue falling short of national development goals and international standards unless these structural challenges receive serious attention.
